Terms of Sale & Website Terms

These terms govern your use of the LuxJet website and any enquiry, reservation, purchase or hire booking made through it. The website is operated by LuxJet Pty Ltd (ABN 78 698 130 228). By using the site or placing an order you agree to these terms. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), where it cannot lawfully be excluded.
Pricing and GST
All prices are shown in Australian dollars (AUD) and are inclusive of GST where applicable. The price payable is the price displayed at the time you place your order, computed on our server. Delivery, on-water handover and any statutory charges are quoted or confirmed separately before completion. We try to keep pricing accurate but may correct obvious errors before accepting your order.
Orders and acceptance
Your order is an offer to purchase. A contract is formed when we confirm acceptance (for example, by order confirmation email). Specifications, imagery, performance figures and lead times are indicative and may change; significant changes will be communicated to you.
Reservations and deposits
A reservation deposit secures a build slot and is credited toward your final purchase price. Deposit refundability is as described at the time of reservation (and, where stated on the configurator, deposits are refundable within the stated period). Reservation balances and timelines are confirmed in writing by our team.
Hire (rental) bookings
Hire bookings are for the dates you select and are charged at the daily rate plus a refundable security bond. The bond is held against loss or damage beyond fair wear and tear and is refunded after the craft is returned and inspected. The hirer must hold any licence required to operate the craft, comply with all maritime and safety laws, and return the craft in the condition supplied. Additional hire conditions (insurance, operating area, fuel, late return) are provided with your booking confirmation.
Payments
Payments are processed by Stripe and PayPal. By completing a purchase you authorise the charge and agree to the applicable provider terms. We do not store full card details.
Your consumer rights (Australian Consumer Law)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. For major failures with goods you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the failure remedied in a reasonable time, and if this is not done, to a refund for the goods or to cancel the service.
Cancellations, returns and refunds
If you change your mind, cancellation of a reservation, order or hire is subject to the terms confirmed at the time of order; bespoke, made-to-order and custom-configured craft may not be cancellable once production has begun, except where you have a right under the ACL. Nothing in this section limits your rights under the consumer guarantees described above. To request a return, refund or repair, contact us at admin@luxjet.com.au.
Delivery and risk
Delivery and white-glove handover are arranged across Australia and quoted per order. Risk in goods passes to you on delivery or collection. Title passes once payment has been received in full.
Intellectual property
All content, branding and imagery on this site are owned by or licensed to LuxJet Pty Ltd and may not be reproduced without our written permission.
Liability
To the maximum extent permitted by law, and subject to the consumer guarantees and your rights under the ACL, our liability for any failure to comply with a consumer guarantee is limited (at our option) to resupplying, repairing or replacing the goods or services, or paying the cost of doing so. We are not liable for indirect or consequential loss to the extent that liability can lawfully be excluded. Nothing in these terms operates to exclude liability that cannot be excluded under the ACL.
Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State/Territory and the Commonwealth of Australia.
